Can a spouse remove his legal mate as beneficiary from all his assets?

You can remove a husband or wife from your will by drafting a new will and not including them. However they can challenge it after your death and they are legally entitled to a third of the estate if they are married to you at the time of your death. If you are not married, they have no right.
