Legal Question in Wills and Trusts in New York

dear all,

i have a question regarding a case to do with my dad's death.

a month ago i got a letter i got from my dad's spouse lawyers regarding a medical malpractice case regarding my dad's death - he died from cancer, and one of the biggest firms dealing with those cases took the case.

the communication with the spouse was very misleading - i got notified about the whole case a week before i got the letter and she asked to sign the waiver and not to tell anyone, while raising some questions regarding the case all i was communicated is that the case has nothing to do with money, and just to find the guilty ones (which is not the case, otherwise the firm will never take the case).

i know the will is written in the last days of my father life is given to his spouse, if in a case of her not being able to handle it to my sister (which lives with her), and i'm the third person on the will, if my sister is not able to handle the will...

as i understand the whole case is just about the money, and i am willing to get my share (25% as i know regarding the NY law), my family (the spouse and my sister) aren't transparent and honest with me, and i'm looking to understand how to approach and represent my interests, i'm living in the EU, so it ain't easy to find a lawyer here that can do so.

any help or advice will be great.

Your problem has a simple answer. You need to retain an estate litigation attorney ASAP to represent you through the probate process. I have no idea as to the "waiver" you signed that sounds suspicious and you may even be disinherited under the will so I do not know where you are getting 25 percent from. If you are disinherited the only way you will get anything will be to have the will declared null and void.
