Legal Question in Wills and Trusts in New York
my stepmother just passed on my father is in a nursing home i dont think she has a will who does the house and property go to

If the house is only in her name, it would go to your father and her children, if any. If Medicaid is paying your father's bills, they will have a lien against his share after any mortgage is paid off.
