Legal Question in Wills and Trusts in New York

Are we being tricked

Cousin died without a will. My mom is the eldest living relative. Hired an estate lawyer, paid him $6000 for services. He has not given family any information about the progress of the case for more than six months. We do not know what he is doing. When contacted, he doesn't return calls or answer messages. I've done some investigative work and found out that nothing is in probate as yet, and that some property was sold already. What should we do.

You need a Will in order to file for Probate.

Check the Surrogate's Court for an 'Administration' of the estate. It is unlikely that property would be sold without it unless sold directly by the heirs at law.

There may be closer relatives who are entitled to the estate, such as children, or siblings
