Legal Question in Wills and Trusts in New York
Unable to get estate accounting
I am a beneficiary of my grandfather's will and have tried, unsuccessfully, to get an accounting of the estate for over a year. He passed away in Sept. 2006 and I believe he only had investments, no property. Two and half years seems excessive to settle an estate and the executor will not talk to me. How can I find out what is going on?

You may petition the Surrogate's Court for an accounting.

I agree with Mr. Markowitz.
You obviously live in Erie County, New York.
What I usually do in these circumstances is prepare a petition for an accounting, and also include a demand for distribution of the assets of the estate.
This can be done very rapidly, the court issues a citation for the executor to appear in court usually 30 days later, and then gives them an additional 30 days to provide an accounting.
We then go from there.
