Legal Question in Wills and Trusts in New York

am i waiving my rights?

i live in fl. my sister took care of my mother until her passing in 11/08 in ny. to the best of my knowledge, my mother was worth millions. my sister is now asking me to sign a waiver of citation consenting to letters of administration. she claims there was no will. there was an atty's name listed & he claims there is a will. there is no file no. listed on the document. my husband recently died & i don't have the money to hire an atty. what is my best course of action.?

I suggest that you do not sign the waiver until you have spoken with a New York estate attorney. I understand that you feel that you cannot afford an attorney, but there are alternatives. If you wish, you may call me for a free consultation.

Ask the lawyer for a copy of the will. Ask your sister for copies of what has been filed in NY for probate. Tell her you'd prefer not to wiave your right to see the paperwork.
