Legal Question in Wills and Trusts in New York

no will

if someone die with no will their properties go to the spouse and children, what if they are in another country. do they have to come and claim the property and have it transfered in there name and if so , how long before they loose their rights

A person has the right of inheritance by intestacy whether or not in this country. If there are no issues, paperwork may be signed in another country before the US Consulate. It is my understanding that you can only waive your rights, not lose your rights to inherit.
