Legal Question in Wills and Trusts in New York

If there is no will and property is put in an estate with the surviving spouse and surviving siblings how is it decided who is the executor of an estate?

It would be an administrator of the estate and it would be the individual or individuals that petition the Surrogate's Court to be the administrator.
