wills and estates

i live in ny. my grandmother died in 1984 and left everything to my mother. my mother filed and was executor to the estate. she left many of the stocks and bonds in my grandmothers name. now my mom died without a will. i am filing a petition for letter of administrattion for my mom's estate- but what about the remaining assessts in grandma's estate?

You would first have to read the will to see if there is language about an alternate executor. If there is no language, to transfer the assets you would have to petition the Surrogate's Court to be an alternate executor for your Grandmother's estate.

I agree with Mike as to the procedure. You may be eligible to become Administrator of Grandma's estate if no successor Executor has been named in Grandma's Will. An interesting question is why Mom did nothing with the securities. They pass through Grandma's Will, although any portion that would have gone to Mom is now part of Mom's estate, and must be handled as such.
