Legal Question in Wills and Trusts in New York

two wills

my grandfather made a will out in the early 90's making my mom and aunt the executers i recently was taking care of my grandfather and he re did his will and named me the sole executer.my grandfather died about 3 weeks ago and my aunt is trying to probate the will that was done in the 90's and my lawyer is still filling out paper work to probate our current will,can my aunts will be probated before mine and how does this work?

Re: two wills

No. When your Aunt submits the old will to probate, you will receive notice. You will submit the new will and cross-petition to be the executor. If your will is valid, the Court will deem you executor.

As an aside, the easiest way is to talk to your Aunt and tell her that he made a new will deeming you the executor.
