if my grandfather died in 1970 and

left his real property , assets

(everything to my grandmother)

now there is a piece of property that

is still under my grandfathers name

it is my grandmothers' correct? Now

my grandmother dies and she has 3

children and she leaves a will which

clearly states the splits of her real

property etc does she have the right

to claim the property undernrath my

grandfathers name?

I would need more information to definitvely answer the question. Assuming your grandmother's name was also on the deed as joint tenants or his Will was probated and the property transferred to her, then her Estate owned the property upon her death and her Will needs to be probated to tranfer ownership to the 3 children. If the real estate was the sole asset, you may be able to by-pass the probate proceeding and tranfer the property ourtight.
