Legal Question in Wills and Trusts in New York

wills

I recently lost a parent...a family member is the executor of the will and has been negligent in contacting my parent's attorney. Do I have the right to request a copy of the will. I do not believe I am mentioned in the will as I was estranged from the parent; but I do feel that this executor had been instrumental in ''persuading'' my parent in certain matters. Can I also request copies of the funeral expenses (I was excluded from that as well.)a copy of the death certrificate. Am I within any rights to make any requests at all?

Re: wills

As a distributee under law, you are entitled to a

copy of the Will. Unless you contest the Will,

or are mentioned in the Will, the funeral bill

is of no consequence to you, and therefore you

will not receive a copy of it. The death certificate

is slightly more tricky. There is no absolute

right to this, but as a son, you should

probably be able to contact the Bureau of Vital

Statistics in the County where your parents died

pay $ 10.00 for each certificate, and thereby

obtain the same. There probably will not be

any questions asked.
