In New York City - Will Process

Please advise the timing of a will to be executed after the originator is deceased. Also, who is responsible for advising the individuals listed. Thanking you in advance

There is no statute of limitation for submitting a Will for probate but you will be unable to claim any of the estate assets of the decedent until this is done.

The Executor named in the Will must submit the Will to the Surrogate's Court for Probate. This process, generally performed by an attorney, includes mailing Notices of Probate to all persons who would be heirs to the estate if there were no Will.

Once the Surrogate has issued Letters Testamentary to the Executor the Estate may be distributed in accordance with the Will.
