in new york state who is next of kin the minor children of the deceased or mother of the deceased. The deceased was never married.

In New York, the children of a decedent who dies without a Will are considered to be the distibutees (next-of-kin). However, if the decedent was a male and the children were born out-of-wedlock, they may be required to establish paternity.
