Legal Question in Wills and Trusts in New York

In New York state can a surrogate court judge order a homeowner out of their home if the mortgage and taxes are up to date and the property deed is in that person's name? the judge also said this person will be responsible to continue to pay for the home

If these are the only facts - probably not. However, it appears more facts are needed for a complete answer. For example, why is the matter before the Surrogate? How was title acquired? Who has been paying the taxes and mortgage. Are more names on the Deed?
