Legal Question in Workers Comp in New York
Cervical Sprain/back injury - NY
I have been diagnosed with cervical sprain injury and comp has began payment before the hearing since the injury clearly happened at work and there were 2 witnesses. I went to another doc to see if some of the pain was related to my lupus and he found bulging discs in my lumbar region in an MRI (which comp also is covering-but did not pay for this one). This doc is not in the comp loop, but I asked him what he thought about my neck and he gave me a referral to an orthepedic surgeon for both my neck and back bulging discs, narrowing, and spurs. He told me that for the rest of my life in spite of surgery I would not be able to lift more than 15-20 pounds and ''no one would hire me.'' My current job involves lifting- do I just forget I saw him and hope for the cervical (nuero doc) to clear me this week to go back to work regardless of comp accepting my claim. I have 20 good years left to work and 2 degrees that I do not want to lose. I asked the doc about SSDI and he said, ''don't think disability.'' If my doc treating me for the cervical area also believes I need surgery, where am I left besides unemployed? I also have a lawyer that my union rec. to me, worthless...is it possible to change attorneys in mid stream? Oh, MVA W/whiplash11/6

You can certainly change attorneys anytime you want. What firm is currently reprenting you and where do you live?
