Legal Question in Workers Comp in New York
If Im collecting workers comp and dont see the dr within the 45 day, do i loose out on the settlement?

If you are not working as a result of your work related injury then under NY law you are required to see your doctor at least every 45 days. Often times you may see your doctor at longer time periods and this could affect your benefits. I often suggest to clients that they should just make it a point to see the doctor monthly so the doctor (even if he or she cannot do anyhting) can note if you are disabled and if it is realted ot the accident.
If you are working then you do not have to necessarily see the doctor.
