Legal Question in Workers Comp in New York

I work for a Real Estate Company in the NY Metropolitan area. On September 11 when the World Trade Center was attacked I was working alone in our subsiduary office downtown. Due to the horrific events of that day I suffered post tramatic stress which put me out of work for six months. During that time my company only paid me NY State Disability ($150 a week)until my long term disability kicked in which I pay into (60%). When I returned to work I asked for compensation for salary loss and pain and suffering I endured during that time. Two years later and I have not recovered emotional or financially. Should my company have offered me Workman's Compensation? If not do I have a legal right to ask for personal compensation from this firm since I was the only one on the job that day. Should this be a good will gesture on their part for my loyal service? Welfare recepiants live on more money than I had to at that time. Please advise.

This is an interesting case. You may be eligible for workers comp for that period. Other than that, your company's moral obligation and legal obligation are not the same.

Not a comforting answer. When I employed people, I did act more generously than this company.
