Technically no. Not on the same case. However, if you are talking about a "per diem" attorney in workers compensation you should know that some of those attorney work on dozens of cases every day. Moreover, they probably look at the file for a couple of minutes prior to every hearing. Therefore, it is not unusual to see them handling both sides of the same case.
I never use a per diem attorney for the same case when I know that attorney has appeared for the insurance carrier. However, some law firms are not as discerning as I am.
