Legal Question in Workers Comp in New York

Employer does not have a position for employee

My boyfriend installed auto glass. He was injured on job (back injury 3 bulging disk). He has been on work comp since 7/1/02. He was diagnosed as moderatley disabled. Work comp. cut him off financially and medically about 3 weeks ago. He told his work that he could come back to work but not installing glass (per the doctor). They stated they did not have position for him and they put him back on work comp. Can they fire him? Will they provide him with a settlement package? Since he is still classified as disabled will workmens comp. let him continue to get physical therapy again? Can they put him on unemployment? Do we have some kind of case? Please help!! Thk you

you do have a w/c case. You should be able to receive a lump sum settlement at some point. This depends on the state that you are in . Where do you live?
