Legal Question in Workers Comp in New York

I filed a claim againist the US Gypsum asbestos settlement trust for Meso cancer (caused by exposure to asbestos). I worked got USG back in 67 to 68. My claim was denied because I should have filed under workmans comp. This type of cancer does not reveal itself right away. It can take more than 30 years to reveal itself. I was diagnosed in 2001 thirty fours years later. How can the workmans comp laws come into play after that long of a period of time? Need some guidance here, something does not seem kosher. I know live in Illinois but worked for USG in the Grassey Point New York plant. If necessary I can email or fax their letter of refusal.

You should bring your claim to a tort attorney (negligence) in your state that is familiar with mesothelioma claims. Do not try to handle this yourself given the complex nature of such a claim.
