Legal Question in Workers Comp in New York

I was injured at work due to their negligence. This happened on 9/30/10. I was terminated on 10/31/10 through a letter the company mailed to me. I had neck surgery and will need back surgery due to the injury. The IME for comp as well as my doctor have me out as total temp for the foreseeable future. Can my employer terminate me?
