Injury Payment - Workmans' Compensation

I have a workplace injury. I am schedualed for surgery and will need more in the future. Is it my option to request the insurance carrier to make a pay-ment settlement to me and I will live with my injury as there are no guarantees on the outcome of this surgery. I am still able to work now, if this is done, I will be out on total disability for months. This is a shoulder/neck injury.

I received your inquiry on October 4, 2000.

My suggestion is to get a worker's compensation attorney, whose fees are set and are paid directly to them by the carrier.

A lump sum is possible but that has certain implications for you. Also, the carrier must be willing to do that.

Additionally, surgery may not be paid by the compensation carrier if there is a lump sum pay out.
