Legal Question in Workers Comp in New York
Occupational Disease
Recurrent shoulder pain over years - it has come and gone. now advised by doctor that is due to lifting at employment. Surgery is now an option for rotator cuff injury. How do I file and what do i file? Stat. of limitations? I expect to have surgery and be out for recovery time but can come back to work and not lift until recovered.

You need to contact a competent Workers Compensation attorney as soon as possible. Under the law you have a possible ODNCR (occupational disability with notice that is causally related) due to repetitive stress injury on your shoulder. The question of whether or not you can bring a Workers Compensation claim has to due with when you discovered or should have discovered that your shoulder injury was due to work related activities.
