Legal Question in Workers Comp in New York

Can I resign while I have a workerscomp Claim?

I got injured while at work. I work as stocker and my left hand is swelling. I already filed the workerscomp, rightnow my employer is offering me a light duty work, but for me is going to be uncomfortable going back because of my injury the profit sharing will get affected, so if I don't wanna go back to work or can I resign? What will happen to my claims? What option do I have?

Thank you for your timely reponse, more power...

Go back to work within your limitations. If your doctor says that you can do light duty you must go back to work.

Moreover, you have a schedule loss of use award that you are frittering away by remaining out of work.

If you want to go to another job, fine just get off of comp as soon as you are physically able to.

Best of luck.
