Legal Question in Workers Comp in New York

Not returning to work

In NYS, I am out on comp for a hand injury. I have NOT recovered, but have decided NOT to return to work as my pain is not diminishing enough to perform my job. I am considering a career change, as I do not want to sit around forever. What are my options, so I don't hurt my case? I am not sueing or asking for monetary gains, but I don't want to have to pay the medical bills I've incurred if I just quit my job. Also, if I require surgery, I would want it to be covered by this wc case. Any thoughts?

Re: Not returning to work

What does you doctor say? You need a medical basis in order to make the decision that you cannot work due to your injury.

Your situation is somewhat complex. Have you considered whether you have a third party action against another party for your hand injury? I need more information to speak intelligently about the above matters. Please contact me, Pasquale Calcagno, Esq. at 1(800)WE-FIGHT for a free consultation.
