Legal Question in Workers Comp in New York

ripped rotator and hip injury,what steps do I take?

In mid january injured right shoulder and hip/leg during a high torque hand drill mishap.Worked thru the dicomfort until pain became so bad that I had to see my doctor.X-Ray and MRI report confirms ripped rotator and the development of a spur in shoulder .Pain is at an extremely high level in shoulder and leg is getting worse .Am schedualed to start testing foer leg and hip shortly.Taking heavy pain killers and had to see doctor for cortizone shot.Am schedualed for some type of rehab but early indicators do not look good .Operation highly possible .I am afraid for my job,how do I safely proceed to file for workmans comp? As I said I still ned to have the hip and leg tested,and the days Ive missed along with the lost wages and the upcomming time and money needed to deal with the other injury are a strain on my family and I .What will workmans comp pay for and what if I need an operation.How is that handled thru the insurances and workmans comp?

Since your injury occurred at work, workers compensation should pay for all your medical needs and your missed wages as well. A claim petition needs to be filed on your behalf. A motion for medical and temporary benefits (wages) should also be filed on your behalf. In New Jersey if you get injured on the job then you are entitled to have all of your medical needs taken care of for free by doctors or medical facilities authorized by your company's workers compensation insurance carrier. Furthermore, if the authorized doctor puts you out of work, the law says that you are to receive 70% of your weekly pay in the form of temporary disability payments until you are cleared to return to work by that doctor. Most importantly, since it does sound as if you have an injury which may never completely heal, you need to file for a permanent disability award. Based on various medical examinations, a determination will be made as to the extent of disability you have. This will result in a monetary award to you in the form of permanent disability payments. You should contact an attorney who specializes in Workers Compensation cases. Our office handles workers compensation claims and assist individuals like yourself. If you make an appointment with my office, I can find out who your company's workers compensation carrier is and contact them regarding your accident. You are entitled to all your authorized medical bills paid and weekly temporary disability benefits during your course of treatment. As I tell my clients, "You concentrate on getting better, let me concentrate on getting you the money you need to support your family during your treatment." At the end of your treatment, you will return to work as well as possible and I will obtain a monetary award for your permanent (residual) disability (or injury). I have extensive experience dealing with these cases and rarely do I need to contact an employer to effectively handle a case. Your employer already paid for the insurance and they will not be paying anything out of pocket for your injury. Of course, discretion in not contacting them regarding your claim goes a long way to insure your return to your former job.
