Legal Question in Workers Comp in New York

After having a Section 32 settlement hearing, how long thereafter does the payment check arrive? And will attorney receive his own check from settlement or do I make said payment to the firm?

It depends on many factors. Is the 32 structured, is it a lump sum, is there an ATF issue. Things have gotten a lot more complicated lately. The rule is that any workers compensation award should be awarded within 10 days of the Notice of Decision.

The attorney's fee will be a separate check written by the insurance company and taken out of your fee.
