Legal Question in Workers Comp in New York

time limitations for lawsuits

i would like to know whether the date to file a lawsuite in regards to no fault insurance compensation is determined by the date of the accident or the date no fault insurance benefits were stopped. i believe the term is three years if that is correct please acknowledge. thank you

It is not clear what you are referring to. You have 3 years to sue the person who caused the accident running from the date of the accident and this is for pain and suffering etc if you have a serious injury or damages beyond no fault coverage. If you are talking about suing the no fault carrier it depends on what that carrier is not doing. There is also with regards to no fault not paying wages or medical bills, the option of arbitration instead of suing. You should probably discuss these problems whatever they are with a local lawyer who does this stuff.
