Legal Question in Workers Comp in New York
i have a work injury, a rotator cuff tear and 4 herniated disc in the neck that turns degenerative disc deases, can i close out on the shoulder and leave the neck.

While I have seen that before, I have not seen that recently. Typically carriers do not like to pay big money on cases and leave active treatment open. You have two viable options: one go back to work and seek a schedule loss of use of the shoulder while giving you an opportunity to treat in the future or seek a Section 32 settlement for a lot more money that will be a true closure of the case.
