Worker's Comp & Diability Benefits

I have failed back surgery syndrome & am scheduled for placement of a spinal cord stimulator at the end of this month. Three mos. ago I developed bilateral epicondylitis-medial/later on right side & medial on left. I have been treating conservatively for 8 weeks & have had cortisone injections for the tennis elbow. I do repetitive motion in my job (typing/mousing) for 8 hours/day. My question is: if I go out on WC as my elbow pain is not resolving w/repetitive motion will this affect my disability benefits after my back surgery. Should I get a WC AND a disability attorney? My job has accepted culpability for my epicondylitis and has paid for the ortho surgeon's fees & PT. I need to stop this typing/mousing to try to heal my elbows as I do not want another chronic pain condition.

You should get a workers comp attorney immediately. He/ she will be able to discuss your options. You should know that it looks like you have a good comp case and could be entitled to a permanency award (slu) on both of your arms.

Yes, you should get a WC and SSDB attorney so that the insurance carrier does not take advantage of you and to make sure you get all the benefits you are entitled to. I work with an excellant WC/SSDB attorney so feel free to contact me if you want me to put you in touch.
