Legal Question in Workers Comp in New York
workers compensation voluntary removal from workforce
I was determined to have a permanent partial lower back injury 4 years ago. It forced me into an early retirement. Back pain causes me to have sleep deprivation and I am unable to work a normal work schedule. The insurance company says that I have removed myself from the workforce. Can they take away my benefits?

Yes they can. They will cut off your benefits. You should call the lawyer who helped you get the PPD and have him represent you at the next hearing. If they successfully cut off your benefits please contact me and perhaps I can help you get them reinstated.
