Legal Question in Workers Comp in New York

workman's comp

do i have a ''leg to stand on''?

i was involved in a work related auto accident. i was referred to a back specialist and had a muscle reflex test performed. my workmans comp is not paying because the doctor new requested or recieved permission for the tests. unfortunately (for me it seems) i had given the doctor my no fault insurance information so he didn't think he needed permission. now i am getting stuck with the bill because i gave the wrong information and had unwittingly signed a form agreeing to pay bills that were not covered.

although one of the other dozen forms i had to complete had very clear and bold question asking wether or not the accident occurred while in the course of work, and i clearly checked the area next to yes.

so now i'm getting the bill and it's reached ''2nd notice'' status and my question is this:

do i have a ''case'' against paying and/or shouldn't they doctor be partially responsible since i checked off ''yes'' in the work related injury area?

i have no problem paying and learning from my mistake but feel they should split the bill.

any sussestions would be greatly appreciated. thank you.

Re: workman's comp

Do you have a workers' comp lawyer representing you? A good lawyer can probably get this worked out at a hearing.
