Legal Question in Family Law in New Zealand (Aotearoa)
Ex boyfreind's property
I have been seperated from my boyfreind for more than a year & after many attempts to get him to remove his stuff, he has failed to move all of it. I know its an excuse to come over but when I ask him to move his car he gets nasty. He has never been violent but since the breakup I havnt had a life. I need to know how I can get rid of his car without getting into trouble. The car is in his name & I cant afford the cost of having it towed. Im renting a house & the landlord needs it gone, but I do not have any keys for it to even push it on the road. My ex doesnt care about the car but complains to me when he sees a new scratch on it from the kids who play in the yard. Also am I responsible for his car if its in my driveway?

Re: Ex boyfreind's property
His car now represents a legal nuisance on your property. You would be unwise to dispose of it by selling it. However, you are entitled to remove the nuisance. You also have an obligation to your landlord which by this time overrides the property rights of your ex-boyfriend.
If you can get some friends to help you push it (or tow it with another car) onto the street, you could then call the local Council to ask them to remove an abandoned vehicle.
