US Citizens married in NZ now Divorcing

We are US citizens that got married in Aug of 2006 and it appears we are heading for divorce. Do we file in NZ? Is there a length of separation involved? What else would I need to know?

Husband wants the divorce but I don't. Can he file alone?

Assuming you are both residents of MA and both still live here, then either of you can file for a divorce. Generally, there is a six month waiting period for a divorce, not a separation as such.

Your husband does not need your consent to get a divorce, you should contact an attorney to protect your interests.

If you are in New Zealand you must be separated for 2 years before you can file for divorce. You can file by consent which is very straightforward. If one of you does not agree then the other can file but it will involve Court appearances and correspondence.
