Legal Question in Wills and Trusts in New Zealand (Aotearoa)

power of attourney

My 87 yr old father has made my younger sister his power of attourney. Has she the power to make decisions on my fathers behalf without consulting her brothers & sisters? & do we have a right to question her & ask for proof on those decisions?

Is she able to access my fathers funds without his permission?

Re: power of attourney

The powers that your younger sister has depend on the type of Power of Attorney which she has been given. The only way to know for sure is to see a copy of the document.

If this is of serious concern to you, you should instruct a lawyer to request a copy of the document and report to you what it entails, as the consequences of the different types of Power of Attorney are not always spelt out completely in the wording of the document itself.
