Legal Question in Workers Comp in North Carolina
I was injured on the job in 2007 and the company workers comp carrier, Liberty Mutual, has neglected my care and compensation - big time. I am losing my house, have lost my car and cannot work because of my injury. I am no longer able to provide for my family. Can I sue for personal injury due to the fact they are purposefully imposing hardship and stress on my situation by not doing as ordered by NC Industrial Commitee ruling?

There is not a viable personal injury claim against Liberty Mutual; however, there may be potential for what is called a "bad faith claim". I would suggest that you speak to an attorney in that regard.
I would also suggest that you contact an attorney about your workers' comp claim. There are many things we can do in terms of helping you get proper medical attention, work to get your checks coming on time and make sure that you are receiving the proper amount of weekly benefits.
You are not the first victim of Liberty Mutual.
Our courts have held there is no right to bring a "bad faith" claim in a workers comp case. Your "exclusive remedy" is through the NC Industrial Commission. You may also have a meritorious claim for Social Security disability benefits. Get an experienced attorney ASAP.
