Legal Question in Workers Comp in North Carolina

I just received my first work comp check. I was led to believe it was going to be 2/3 of my gross pay, not my net. Is this right?

Your compensation rate is 2/3 of the average weekly wage, including all overtime and bonuses earned over the 52 week period before your injury. So take your gross income and divide by 52 to get the average wage. Then multiply by .6667 to get two thirds. That's what you should be receiving. If you believe the amount is not correctly computed, ask for a Form 22 wage chart to be completed by the employer. Good luck, George
