Legal Question in Appeals and Writs in North Carolina
appealing civil citation
I own an enclosed nightclub in a strip mall. An apartment complex is located behind my nightclub. I have received multiple civil citations due to noice complaints from the same resident of the apartment complex. I contacted the local police station of how I could appeal these civil citations and all I received was a curt response I could not appeal these civil citations. Sorry, but I don't think this is correct information. Am I right or wrong? How can I legally fight what I strongly believe is not right with these pesky noice complaints. No other residents of this apartment complex has ever called to complain of loud music. Now the police have threatened to take my manager to jail if they receive one more noise complaint from this unreasonable person who insists on calling every Monday night of loud music. What can I do?!

Re: appealing civil citation
The appeal process may depend on the authority issuing the citation, but there should be some means of appeal. You probably need to contact an attorney and provide him or her with more information. Basic principles of due process should entitled you to a route of appeal. These cases can sometimes even involve measuring the decibels coming from the establishment.
