Legal Question in Banking Law in North Carolina
what is the statute of limitations in North Carolina for a bank to take me to court over an over drafted checking account from 3 years ago because of my ex wife? the bank has hired an outside debt collecting attorney to take me to court. but by this September it will have been three years since this happened

3 years from the time that the money was owed. Is the attorney in NC or not? If the attorney is in NC then you can be sued prior to September of 2014. If your name is on the bank account then you are going to be primarily responsible. I don't know why this was not resolved before or in your divorce action but if you are sued you can bring cross-claims against your ex-wife if you believe she should be solely or partly responsible.
