Legal Question in Bankruptcy in North Carolina

Cannot afford an attorney to file bankruptcy

I have lost my 2nd job in 18 months. I paid as much as possible to creditors the 6 months that I did work & now I have no income. What can I do? If I tell each creditor I cannot pay them or for a bankruptcy will they prosecute against me? Would I go to jail for this? I have no assets. Jobs are scarce here. I've hit bottom & need help!

Re: Cannot afford an attorney to file bankruptcy

You cannot be sent to jail or prison if you cannot pay your bills. Your creditors may sue you and get a civil judgment, but they cannot garnish your wages and in most cases similar to yours they cannot take any of your property. Before you file for bankruptcy you would have to go through a credit counseling class, and that is probably the best place for you to start. Call Family Service of the Piedmont in Greensboro, or Consumer Credit Counseling Service of Forsyth County and schedule an appointment to talk about your situation. They will explain all available options. There is no fee unless you decide to file for bankruptcy, and then there may be a very small fee for the required certificate.

The bankruptcy law has a provision for people who cannot afford to pay the filing fee. To find a lawyer who might be willing to handle your case free of charge, you might contact the Legal Aid office in Greensboro. They do not handle bankruptcy, but they might be able to refer you to a lawyer who does handle bankruptcy and is willing to help people in your situation.

You will have to call information or look these agencies up in the phone book because we cannot post phone numbers here.
