Legal Question in Bankruptcy in North Carolina
Creditors have started calling me after bankruptcy is discharged
My chapter 7 bankruptcy was discharged in July of 1997 and I have experienced no problems. However, this week I have received 2 notices of intent to collect debt on these discharged items. this note indicates that I should provide this collection service with any information that might be pertinent to my case, including any bankruptcy information. If I do not respond, the note continues to say, they will assume this debt is valid.
Do I even have to respond to this note. If they continue to send me notes, or even make a notation on my credit report, do I have any recourse.
My inclination is to just ignore these queries. I answered the first one, telling them my bankruptcy information. However, I fully expect to receive more next week. It appears they are just fishing.
thanks for your response.

Re: Creditors calling after bankruptcy discharge
I suggest sending them a copy of the discharge and the mailing matrix. If they continue to call, contact a consumer lawyer - you may have an action for violation of fair debt collection practices.
