Legal Question in Bankruptcy in North Carolina

State of residence

We have lived in North Carolina for 4 months. Previously we lived in Michigan. In the bankruptcy laws it states you must have lived in the state you're filing in for the previous 180 days. Can we file in North Carolina, or do we have to go to Michigan to file?

Where to file bankruptcy

If you are in a big rush, you must file in Michigan. Why not just wait 2 more months and file in NC? Your attorney will have plenty of time to put your petition together and be sure it is all-inclusive and correct in every detail. Were I in your shoes, I'd wait and file in NC.

Another factor to consider is whether is is economically more favorable to file in one state than the other. Generally, southern states let you keep more of your property than northern ones.
