Legal Question in Business Law in North Carolina
My 1 year old son was kicked out of day care due to biting. There was no written warning nor were there any steps taken to redirect the childs attention. There was a verbal warning but no warning was written to give notice of the situation. Tuesday of this week that once the week was finished he could not come back. This behavior does not happen at home so, neither my wife nor myself can see it. Is there any legal precidence due to not recieving written warning of expulsion?

As a Franchise Attorney I can say this. Unless your contract with the day care requires a written warning before expulsion, there is no obligation to provide you with one. Consult with a good business or franchise attorney in your area for specific advice.
