new business

i am currently a 37.5% share holder in a local company but have recently been terminated from my position as secretary/treasurer due to discrepencies in the books.do i have the right to start another company of the same description even though i still own shares in this first compnay?there has been no documents prepared or signed saying i have agreed not to begin another company within so many miles or any other documentation since my termination.

Absent a contract to the contrary, you should be able to start your business. It is not clear, however, whether you could take, e.g., other employees with you, or existing clients, depending on the nature of their agreements.
