Legal Question in Business Law in North Carolina
I understand that you offer free legal assistance with problems like I have. I entered into a non-compete agreement with an employer in NC approx. 4 years ago as part of a condition to be employed. The contract states that for X amount of dollars they expect this from me. Well , they recently gave me a 10% cut in pay after no raises in 3 years. I cannot even make it on this and could barely do it on what I had. The licenses that I have took me almost 10 years to get and this is all that i know to do for work. They have for the past year been laying off employees left and right with the largest lay off happening last week. I have been mistreated as an employee during these 4 years but was scared to leave because of the economy and threats made to everyone that if they did leave they would be sorry that they ever did. Well , after all of the lay offs last week and the 10% cut in pay , I found a local employer who would hire me and give me a raise!! The legal concern I have is going to work for a competitor within their ridiculous 100 mile radius and within 1 year. I go paycheck to paycheck with my family of 3 small children and my wife who cannot work yet legally in this country. There is no way that I could move which would ultimately mean that I would lose MY licenses if I did not continue work in NC during that time. Ultimately meaning also that I would lose all of my associated credentials rendering me useless to anyone hiring for the only type of work that I can do.What can I do?

As a Franchise Attorney I can say this. Giving advice without seeing the actual contract you signed is legal suicide; no attorney will do it. You asked what to do. Bring your agreement to a good business or franchise attorney in your area for review and specific advice.
