Can a Judge Convict You Twice?

Can a judge that you go before in District Court - be the same Judge five years later for Superior Court for the Appeal?

Obviously not! Does that sound in any way fair to you? Nor would it to an appeals court, for that reason the judge will probably recuse himself, but if he does not file a declaration of prejudice against him. You have legal grounds. DO NOT, HOWEVER, WAIVE YOUR RIGHTS...BE CAREFUL.
