is it legal to record some one secretly, and without consent?

It is not legal to record interstate calls and, in some states, intrastate calls without the permission of all parties. It is legal to record someone in person, not on the telephone, secretly, but it is a horrible idea. Be prepared to have that person go ballistic if/when s/he finds out about the clandestine recording.
