Legal Question in Constitutional Law in North Carolina

Legally Obtained Evidence

Suppose police were in hot pursuit of a suspect. The suspect went into a stranger's house. The police followed the suspect inside the house stumbling onto some evidence that is in plain view. The evidence is related to a different crime. Are the police able to legally obtain that evidence or would it be excluded?

Re: Legally Obtained Evidence

If the court agrees that police were in hot pursuit at the time, the evidence would have been obtained legally and would not be excluded on that basis. It is possible, of course, that there would be some other reason why it would have to be excluded.
