Legal Question in Consumer Law in North Carolina

Advertisement Fraud

We put money down on a double wide trailer we filled out an application on the home and were approved. Now they are trying to tell us that the house is 50,000 not 39,995 three weeks later saying that an employee had put the wrong price on the house. Is that legal since we put down money on the house when we thought the house was 39,995 we would like to know what we can do about it and if they can change the price on us like that? Thank u for your time.

Re: Advertisement Fraud

There are two approaches, both can be used together.

First, notify your Attorney General's Consumer Fraud division. There are usually laws that regulate "bait and switch" tactics like this. If they put $39,995 on the contract and signed it with you, and are now trying to make you pay more, it may indeed be a very classic case of bait and switch.

On the other hand, you could go to a private attorney in North Carolina and detail your account. What you may find is that you have the background to be a class plaintiff in a class action lawsuit because the dealer may be doing this to everyone. At any rate, a local attorney should be able to make them live up to their promises, and the AG should punish them if they are breaking the law.
